Employment Agency License – Terms and Conditions:

The main practical change in the conditions for obtaining a license for an Employment Agency in Poland is that, during the first two years of operation, the Employment Agency may only mediate employment for Polish citizens.

For those two years, the agency must report that it has been carrying out such activities. Only after two years of active operation may it start mediating employment for foreign nationals.

After two years of conducting active business activity, if you wish to provide job placement or temporary work services for foreigners, you must apply for a change of entry in the KRAZ (National Register of Employment Agencies).

 

Providing job placement and temporary work services is a regulated activity.

To operate as an employment agency, one must obtain an entry in the National Register of Employment Agencies (KRAZ).

The register is maintained by regional marshals, and applications are submitted electronically via the STOR system.

Who Can Use the Service:

Polish and foreign entrepreneurs conducting business in Poland.

Entities must have a premises where they provide services, including storage of documents of temporary workers and job-seekers.

 

Job Placement Includes:

Assisting individuals in finding employment.

Supporting employers in recruiting employees.

Providing information on job opportunities and the labor market.

Referring people to work in Poland and abroad.

Temporary Work:

Employing temporary workers and assigning them to user employers.

Exceptions from KRAZ Registration:

Sending one’s own employees abroad (under international agreements).

Internships, apprenticeships, vocational training.

Activities of social, educational, or public organizations (non-commercial).

Conditions for Entry in KRAZ:

Having a premises in Poland (if applicable).

No tax or social security arrears.

No criminal record for offenses related to agency activity.

The company must not be in liquidation or bankruptcy.

Foreign entities may direct foreigners to work in Poland only after two years from KRAZ registration and after actively providing job placement or temporary work services during that time.

Fees:

  • PLN 1,000 – registration fee.
  • PLN 17 – optional stamp duty for a power of attorney.

Reporting:

  • Every employment agency is required to submit an annual report in January for the previous year’s activities. Failure to submit the report on time disqualifies the Employment Agency.

Processing Time:

  • Usually 14 days from submission of a complete application.

Consequences of Lack of Registration:

  • Operating an agency without registration may result in a fine from PLN 3,000 to PLN 100,000.

Changes to KRAZ Data:

  • Any change in company data, management personnel, or type of services provided must be reported to the regional marshal within 14 days.
